Terms & Conditions

Last updated: September 2026

These Terms & Conditions apply to services provided by Townhouse Notary, including mobile notary services and remote online notarization services. By scheduling an appointment or using our services, you acknowledge and agree to the following terms.

Notarial Services

Townhouse Notary provides notarial services in accordance with applicable New York State law.

A notary public serves as an impartial witness to the execution of documents and performs other notarial acts authorized by law. A notary does not verify the truth, accuracy, or legal effectiveness of the contents of a document.

Completion of a booking does not guarantee that a notarization can or will be performed. The notary may decline or discontinue a notarization when required or permitted by law, including when satisfactory identification cannot be established, the signer does not appear to be acting willingly, the signer is unable to communicate directly with the notary, the document or requested notarial act presents a legal or procedural issue, or the notarization otherwise cannot lawfully be completed.

No Legal Advice

Townhouse Notary is not a law firm and does not provide legal advice.

Unless independently authorized by law to do so, a notary cannot select a notarial act for a signer, determine which type of notarization a document requires, prepare or draft legal documents, interpret the legal effect of a document, or advise a signer about whether or how to complete a document.

If you are uncertain about the type of notarization you require or have questions concerning the legal effect of your document, please consult the document’s issuing or receiving organization or a qualified attorney before your appointment.

Identification

Each signer must provide identification satisfactory for the requested notarial act and consistent with applicable New York law.

For remote online notarizations, additional identity-verification procedures may be required through the technology platform used to conduct the session. A notarization cannot proceed if required identity-verification procedures are not successfully completed.

Your Documents

Clients are responsible for providing documents that are complete and ready for notarization.

Please do not sign a document before your appointment unless you know that the particular notarial act permits or requires a previously executed signature. Certain documents must be signed in the notary’s presence.

Townhouse Notary does not determine whether a document is legally sufficient, properly drafted, complete for its intended purpose, or acceptable to the organization that will ultimately receive it.

Witnesses

Some documents may require one or more witnesses in addition to notarization. Unless specifically agreed upon in advance, the client is responsible for determining whether witnesses are required and for arranging for any required witnesses to be present.

A notary’s presence does not replace a separate witness when a document or applicable law requires one.

Mobile Notary Appointments

For mobile appointments, clients must provide an accurate appointment address and any information reasonably necessary to access the location, including apartment, suite, floor, doorman, security, or building-entry instructions.

Travel or convenience charges, when applicable and permitted, will be disclosed before or during the booking process. Statutory notarial fees and any separately permitted charges will be identified as appropriate.

If the notary is unable to access the location, cannot reach the client, or cannot complete the notarization because required signers, identification, witnesses, or documents are unavailable, applicable travel, cancellation, or appointment fees may still apply as disclosed at booking.

Remote Online Notarization

Remote online notarizations are conducted using an approved electronic notarization process and communication technology.

Clients must have access to compatible technology, a reliable internet connection, any required identification, and the ability to complete the platform’s identity-verification process.

The signer must personally participate in the live audio-video session. A remote online notarization may be delayed, rescheduled, or discontinued if identity verification fails, the audio-video connection is inadequate, required documents cannot be accessed or completed properly, or another condition prevents the notarization from being lawfully performed.

Electronic notarization sessions and related records may be recorded and retained as required by New York law.

Fees and Payment

Fees applicable to your appointment will be disclosed through the booking process or otherwise communicated before services are performed.

Additional notarial acts or services requested during an appointment may result in additional charges where permitted by law.

Payment is due according to the terms presented at booking or invoicing.

Cancellations, Rescheduling & No-Shows

We understand that plans change. Appointments may be cancelled or rescheduled without charge up to two hours before the scheduled appointment time.

Mobile appointments cancelled with less than two hours’ notice may be subject to a $25 late-cancellation fee. A $50 no-show fee may apply if the notary arrives at the agreed location and the client or signer is unavailable or the location cannot be accessed.

Remote online appointments cancelled with less than two hours’ notice may be rescheduled without charge. A $25 fee may apply to a remote appointment for which the signer does not appear and has not provided notice.

If an appointment cannot proceed because required identification, documents, signers, or witnesses are unavailable, applicable late-cancellation, no-show, or travel charges may apply.

There is no charge when Townhouse Notary cancels an appointment. Any prepaid amount for services that were not performed will be refunded as appropriate.

We recognize that unexpected circumstances happen and reserve the discretion to waive cancellation or no-show fees when appropriate.

Appointment Times

We make every reasonable effort to arrive or connect at the scheduled time. Mobile appointments may occasionally be affected by traffic, transportation, building access, weather, or circumstances outside our control.

Clients who expect to be late should contact Townhouse Notary as soon as possible. Significant delays may require an appointment to be rescheduled.

Refusal or Discontinuation of Service

Townhouse Notary reserves the right to decline or discontinue a notarial act when the notary reasonably determines that proceeding would be improper or inconsistent with applicable law or professional obligations.

This may include circumstances involving identification concerns, suspected fraud or coercion, questions regarding the signer’s willingness or awareness, incomplete documentation, inability to communicate directly with the signer, or requests that exceed the lawful role of a notary public.

Privacy and Electronic Communications

Information provided through our website, scheduling system, payment processor, electronic notarization platform, email, or other communications may be processed by third-party service providers used to deliver our services.

Please avoid sending sensitive personal information by ordinary email unless specifically requested. Documents submitted for notarization will be handled with reasonable care and used in connection with providing the requested service and complying with applicable legal and recordkeeping obligations.

Data Sharing

• Customer data is not shared with 3rd parties for promotional or marketing purposes.

• Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.
